TERMS OF SERVICE AND REFUND POLICY

1. Acceptance of Terms

By accessing or using any services provided by NISSIRESAUX (hereinafter referred to as “the Company”), including but not limited to Hosting, Web Design, Radio Streaming, Tele Streaming, Android & iOS Applications, TV Intro services, QR Code Generator, Encoder Stream, and Domain Name registration (collectively, the “Services”), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service, Privacy Policy, and Acceptable Use Policy.

If you do not agree with any part of these Terms, you must immediately cease using the Services.

These Terms are designed to comply with applicable international regulations, including but not limited to ICANN policies for domain names, electronic payment regulations, and digital services standards.

You represent and warrant that you are at least sixteen (16) years of age, or the minimum legal age required in your jurisdiction.

2. Lawful Use of Services

You agree to use the Services only for lawful purposes and in full compliance with all applicable laws, regulations, and international standards.

The following activities are strictly prohibited:

• Distribution or use of pirated or unauthorized software
• Use of hacking tools or unauthorized system access
• Hosting, transmitting, or linking to illegal, harmful, or abusive content
• Infringement of intellectual property rights
• Any form of hate speech, exploitation, or unlawful activity

The Company reserves the right to suspend or terminate any account engaged in such activities, without prior notice and without refund, where permitted by law.

3. Account Responsibility

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

Any unauthorized use or breach must be reported immediately.

The Company shall not be liable for any loss or damage arising from your failure to comply with this obligation.

4. Right to Refuse, Suspend, or Terminate Services

The Company reserves the right, at its sole discretion, to refuse, suspend, or terminate access to the Services at any time, with or without notice, particularly in cases of:

• Breach of these Terms
• Non-payment or billing issues
• Legal or regulatory obligations
• Security or operational risks

5. Billing and Payment Terms

All Services are provided on a prepaid or subscription basis.

• Invoices are issued ten (10) days prior to the renewal date
• Payment must be completed before the due date
• Failure to pay may result in immediate suspension
• Continued non-payment may result in permanent termination
• Automatic billing may be processed through authorized payment methods (credit card, PayPal, or other providers)
• You are responsible for maintaining valid and sufficient payment methods

Late payments may incur additional fees and/or service interruptions.

6. Suspension and Termination Procedure

• A reminder notice will be sent after the due date
• Services will be suspended within twenty-four (24) hours of non-payment
• Services may be permanently terminated after forty-eight (48) hours of continued non-payment

Reactivation of Services is not guaranteed and may be subject to administrative review and additional fees.

7. Refund Policy

7.1 General Policy

Refunds are granted at the sole discretion of the Company, unless otherwise required by applicable law.

7.2 Eligible Services

Refund requests may be considered for the following Services:

• Mobile application development
• QR Code Generator services
• Encoder Stream services
• Other digital services

Requests must be submitted within five (5) calendar days from the date of initial purchase.

7.3 Non-Refundable Services

The following Services are strictly non-refundable:

• Domain name registrations, renewals, and transfers
• Services that have been fully delivered, activated, or completed
• Accounts terminated due to violation of these Terms
• Fees paid to third-party providers

7.4 Domain Name Policy (ICANN Compliance)

All domain name Services are governed by applicable ICANN regulations and third-party registrar policies.

• Domain registrations are final and non-refundable once processed
• Domain modifications or corrections may be requested within five (5) days, subject to registry rules and approval
• The Company does not guarantee modifications or reversals once registration is completed

8. Limitation of Liability

To the fullest extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of data, revenue, or business opportunities arising from:

• Use or inability to use the Services
• Service interruptions or failures
• Unauthorized access or security breaches

9. Disclaimer of Warranties

The Services are provided “as is” and “as available,” without warranties of any kind, express or implied.

The Company does not guarantee uninterrupted, secure, or error-free operation of the Services.

10. Modifications to Terms

The Company reserves the right to modify or update these Terms at any time.

Continued use of the Services after such changes constitutes acceptance of the revised Terms.

11. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the applicable laws of the jurisdiction in which the Company operates, unless otherwise required by mandatory consumer protection laws.

Any disputes shall be subject to the exclusive jurisdiction of the competent courts.
